Family Based Immigration and Visas to Thailand

The Thailand O visa (“O” stands for “other”) has been a widely utilized Thai travel document although many who use it are unaware of its originally intended purpose. Initially, the Thai O visa was meant to be used as visa category in situations where no other category could be used. Today, it is primarily utilized by family members of Thai nationals. At one time, the immediate family members of Thai Citizens could easily obtain Thai Permanent Residence. Today, Permanent Residence in the Kingdom of Thailand is a more difficult legal status to achieve (although certainly on impossible). The Thai O visa’s role has since changed dramatically as it has become the travel document of choice for those who wish to remain in Thailand in order to stay with Thai children or spouses. That being said, there is currently a financial requirement for those in the Kingdom on a Thai visa. At present, the Thai Immigration rules dictate that a Thai O visa recipient must show a statutorily prescribed amount of money in a Thai bank account. This statutorily prescribed amount of money seems to constantly fluctuate so those interested in obtaining a visa such as this would be wise to contact a Thai Immigration attorney.

O visa category is not exclusively for family based immigration to Thailand. Thai O visas may also be used by those who wish to retire in Thailand as the retirement visa is technically a sub-category of the “O” visa designation. Therefore, those foreign nationals age 50 or over who wish to retire and can prove adequate financing are encouraged to apply for a Thai retirement visa under the O category. With that being said, those in Thailand for retirement purposes are legally prohibited from taking up any type of employment as such activities contravene the purpose of the Thai Retirement visa.

Occasionally, O visas are utilized by those simply remaining in the Kingdom for a long period of time for recreational purposes. Increasingly, this method of lawfully remaining in Thailand is being phased out as Thai Immigration officials are becoming ever less accommodating to those using this “catch-all” category for non-specific immigration purposes. From a strictly technical standpoint, this practice remains legal, although somewhat frowned upon.
